Auld Foundation Cask
Terms & Conditions
The Foundation Harvest Cask offer is limited to the first one-hundred customers who have hand filled, or hand fill themselves (on farm), an Auld Distillery Harvest Cask.
The owner is purchasing the single malt new spirit that fills the selected Foundation Harvest Cask and purchasing the selected Foundation Harvest Cask for the life of maturation up to 15 years. The owner is the sole legal owner of:
a — The single malt spirit that fills the selected Foundation Harvest Cask
b — The selected Foundation Harvest Cask.A non-refundable twenty percent deposit is due upon signing of this agreement.
The balance is due prior to filling of the cask.Once the Owner has finalised their cask purchase, a filling date will be decided by Auld Distillery.
Upon filling Auld Distillery will provide the Owner with their Foundation Harvest Cask pack containing a 100mL sample of your new spirit with a 100mL bottle of the Auld Farm spring water, an authentication certificate, two bespoke Norlan whisky glasses and details of the distillation.
Auld Distillery will send the owner two samples of their Single Malt spirit, one at half maturation and one six months prior to bottling.
Auld Distillery will contact the owner six months prior to bottling to discuss bottling, date, strength and the option of further maturation – costs apply.
Bottling is included in the purchase price, The Owner may choose to bottle in the foundation bottling option provided or pay for an upgrade to a premium personalised bottling.
There will be no excise duties or taxes or other government charges payable by the owner until the cask has matured and been bottled. The owner will be responsible for the payment of all excise duties and tax and other government charges levied in respect of the cask and its contents. The bottles containing the spirit and the bottled spirit shall not be able to be collected or uplifted by the owner from Auld Distillery until all such duties and taxes and government charges are paid in full by the owner.
In the unlikely event that the owners cask is damaged or becomes empty during maturation, we will provide to the best of our ability the nearest possible replacement cask in terms of distillation date and type of wood.
Two months after the agreed bottling date for the Foundation Harvest Cask if the owner has not arranged final payment terms, Auld Distillery reserves the right to purchase the cask from the Owner, with spirit for $1 incl. GST.
The size of Angels Share at Auld Distillery is unknown.
Price of Foundation Harvest Casks includes storage, insurance at Auld Distillery, foundation bottling, the owners cask - shipping at owners expense.
Price of Foundation Harvest Casks is excluding all government excise duties and taxes and other government charges (as referred to in clause 9), freight and premium bottling.
The owner is welcome to visit Auld Distillery at anytime by prior arrangement to
view our farm and distillery and sample your cask.The foundation harvest cask must be matured in bond on farm at Auld Distillery.
The owner will keep their contact details up to date with Auld Distillery. The owner includes the owner’s executors and personal representatives. The owner shall not assign or mortgage or change the owner’s property in or interest in the cask or spirit without written approval from Auld Distillery.
The parties acknowledge that the transaction referred to in this Agreement constitutes a security interest in the Foundation Harvest Cask and its contents pursuant to the Personal Property Securities Act 1999. Provided the owner has supplied all of the information in the Owner’s Schedule attached, Auld Distillery Limited will register the owner’s security interest in the Foundation Harvest Cask and its contents in the Personal Property Securities Register.
